Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TEKs - Upsell Bundles (the “App”) provided by TEKs Pvt Ltd (“we”, “us”, “our”). By installing or using the App, you agree to these Terms.

Acceptance of terms

By installing the App from the Shopify App Store or otherwise accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

Eligibility and authority

You represent that you are at least the age of majority in your jurisdiction and that you have the authority to bind the business or Shopify store to these Terms. You are responsible for ensuring your users (staff/agents) comply with these Terms.

Description of the service

The App helps merchants configure and display upsell/bundle offers, measure performance, and manage related settings. Features may include product bundles, Mix & Match bundles, BOGO offers, and volume discounts, depending on your plan and configuration.

Account responsibilities

• You are responsible for maintaining the security of your Shopify account and admin access.
• You are responsible for the accuracy of information you provide to the App.
• You must ensure your storefront content and offers comply with applicable laws and Shopify policies.

Shopify integration and platform dependency

The App integrates with Shopify using Shopify APIs and, where applicable, webhooks. The App’s functionality may depend on Shopify’s platform availability, API behavior, and Shopify’s policies. Shopify may change or discontinue APIs or features, which can impact the App. We will use reasonable efforts to maintain compatibility, but cannot guarantee uninterrupted functionality.

Permitted use

You may use the App only for legitimate business purposes associated with your Shopify store.

Prohibited use

• Do not misuse the App, including attempting to access data you are not authorized to access.
• Do not interfere with or disrupt the App, Shopify services, or related systems.
• Do not reverse engineer or attempt to derive source code from the App except where permitted by law.
• Do not use the App to violate applicable laws, regulations, or Shopify terms.

Fees and billing

The App may be offered on free, trial, or paid plans. If billing is handled through the Shopify Billing API, charges, trials, renewals, and cancellations may be administered through your Shopify account.

• You authorize applicable charges based on the plan you select.
• Taxes may apply depending on your location and Shopify’s billing configuration.
• If you downgrade or cancel, changes may take effect at the next billing cycle as reflected in Shopify.

Third-party services

The App may rely on third-party services (e.g., hosting, analytics, support tools). Your use of third-party services may be subject to their terms and policies. We are not responsible for third-party services outside our control.

Intellectual property

We own all rights, title, and interest in and to the App, including software, design, and branding, except for any third-party components. You receive a limited, non-exclusive, non-transferable license to use the App during the term of your subscription.

Feedback

If you provide feedback or suggestions, you grant us permission to use them without restriction or compensation.

Availability, maintenance, and modifications

We may update, maintain, or modify the App from time to time. We may add or remove features, and we may suspend the App for maintenance. We aim to provide reasonable notice for material changes where feasible.

Disclaimer of warranties

The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free or uninterrupted.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from or related to your use of the App. Our total liability for any claim will not exceed the amounts paid by you for the App in the three (3) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless TEKs Pvt Ltd from claims arising out of your use of the App, your store operations, your offers/content, or your violation of these Terms or applicable law.

Termination and suspension

You may stop using the App at any time by uninstalling it from Shopify. We may suspend or terminate your access if we believe you violated these Terms, created risk, or used the App in a way that could harm the App, Shopify, or others.

Effect of uninstall or termination

Upon uninstall or termination, the App will stop functioning in your store and will no longer access Shopify store data via Shopify APIs. Data retention and deletion are handled as described in our Privacy Policy.

Data handling after termination/uninstall

After uninstall, we may retain certain information for the period described in the Privacy Policy for legitimate business purposes such as security, billing reconciliation, support, and legal compliance, unless you request deletion where applicable.

Governing law; jurisdiction

These Terms are governed by the laws of Pakistan. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

Dispute resolution

Before filing a formal claim, you agree to contact us to attempt to resolve the issue informally. If we cannot resolve it, you may pursue remedies available under applicable law.

Changes to terms

We may update these Terms from time to time. We will post updated Terms on this page and update the effective date. Continued use of the App after changes become effective constitutes acceptance.
